
Only 2% of the dwellings in each neighborhood may be used for tourist apartments. The Local Government Board of Valencia has announced today the draft of the new regulations that will govern the tourist rental in the city of Valencia, and this will be one of the main novelties.
This 2% limitation will affect all neighborhoods, except Ciutat Vella, which has a specific regulation.
As was the case with the new moratorium on rentals already approved, tourist apartments will not be allowed to be in buildings with other residential dwellings, unless they meet the following conditions: they must be located on the ground or second floor, but with independent access to the rest of the property.
If the first floor of a residential building is to be used as a tourist apartment, it must have the consent of the community of neighbors, registered in its bylaws, details the consistory.
Valencia now also establishes a limit to new licenses: new tourist places (hotels and apartments) cannot be created in districts where the existing tourist places exceed 8% of the number of registered residents. For example, if 10,000 people live in a district, there cannot be more than 800 tourist places (8% of 10,000). If this number has already been reached, no more new tourist accommodations will be allowed.
A figure that is already exceeded in areas such as Poblats Marítims and Ciutat Vella. In these cases, the issuance of new licenses will not be allowed.
Tourist housing will not be allowed to exceed 5% of the total number of dwellings in the same residential block, thus avoiding excessive concentrations in small areas.
Regarding the reversion of commercial premises to housing, only 15% of the commercial premises within a residential block may be used for tourist housing. The remaining 85% must have other tertiary uses, such as offices, hairdressers, restaurants, pharmacies, clinics, etc.
As of July 1, the national short-term rental tracking system, called Ventanilla Única Digital de Arrendamientos de España, will be implemented in order to have a more exhaustive control of the data when establishing controls by areas.
The draft of this regulation will now go through a consultation phase with neighbors and political groups, before being finally approved in plenary. Meanwhile, Valencia will keep active the two moratoriums on tourist rentals approved at a general level and in the Cabanyal, which suspend the processing of tourist licenses.
